Getting out of jail is free!

Fantastic news today from the Electronic Frontier Foundation (EFF). �After a lot of hard work and mountains of paperwork, jailbreaking your iPhone is now explicitly a permitted fair use under the DMCA!

The first of EFF?s three successful requests clarifies the legality of cell phone ?jailbreaking? ? software modifications that liberate iPhones and other handsets to run applications from sources other than those approved by the phone maker. More than a million iPhone owners are said to have ?jailbroken? their handsets in order to change wireless providers or use applications obtained from sources other than Apple?s own iTunes ?App Store,? and many more have expressed a desire to do so. But the threat of DMCA liability had previously endangered these customers and alternate applications stores.
In its reasoning in favor of EFF?s jailbreaking exemption, the Copyright Office rejected Apple?s claim that copyright law prevents people from installing unapproved programs on iPhones: ?When one jailbreaks a smartphone in order to make the operating system on that phone interoperable with an independently created application that has not been approved by the maker of the smartphone or the maker of its operating system, the modifications that are made purely for the purpose of such interoperability are fair uses.?

The EFF also successfully renewed the existing DMCA exception for carrier unlocking. �More on the ruling by the Library of Congress is here and here (and many other places, since this is huge news!). The full ruling is here, and EFF?s history with this case is here (EFF?s servers are understandably getting hammered today!).
This doesn?t mean that Apple will stop their technical attempts to thwart jailbreaking, but it does mean that our iPhone jailbreaks and unlocks are now unambiguously legal under the DMCA.

Schiller answering questions on Twitter

Last week, we reported that Apple's Phil Schiller has gotten a verified account on Twitter, and since then, his popularity on the short form social networking service has apparently skyrocketed. Rather than just retreat to the shadows, he's stepping up into the limelight, sharing insights and answering questions of all kinds from Apple fans. It's pretty awesome, actually -- he's sharing everything from his favorite apps to why you have to put in your iTunes password every time you install a new app (for security's sake -- Apple wants your approval for every piece of software on your machine). It's cool to see a senior member of Apple not named Jobs getting so hands-on with Apple's customers.

TechCrunch has a few other tidbits from Schiller's tweets so far: the @appleincnews account that seems real on Twitter actually isn't, but the @itunes accounts are completely official. And he hasn't yet tried Reeder for Mac, but he is a fan of the iOS version.

All in all, it seems like Schiller is really "getting" Twitter -- he's declined to share his Game Center name, so he still wants some privacy, but he is using the service as it's meant to be used, reaching out directly to customers en masse. New MacBook Pro could arrive in April 2011 with SSD, Light Peak, no DVD

Update Put your checkbooks away, folks. Electronista has all but debunked this rumor. By crunching the numbers, they confirmed that (at today's prices at least), such a MacBook Pro could easily be priced out of the market. Read on and dream, but don't expect this machine to appear on your desk any time soon.

Three Guys and a Podcast are reporting that the next-generation MacBook Pro will likely arrive in April 2011 with a new design inspired by the latest slim-line MacBook Air. That means that the high-end laptops will probably dispense with spinning drives altogether and come equipped only with solid-state drives of up to 512GB capacity. If you haven't yet finished ripping all of your CDs and DVDs, you'll want to complete that task before migrating to a new MBP because the internal optical drive will probably follow the floppy into the annals of history.

With the internal speed bottlenecks reduced by the flash memory drives and new Sandy Bridge CPUs, Apple will also work on speeding up the external communication interfaces. Light Peak may finally debut on the MBP, two years after it was originally announced by Intel. Whether or not Light Peak makes it to the party, we expect that USB 3.0 probably will arrive in an Apple product on these new machines. The fate of Firewire is unknown at this time, but it seems unlikely to make the cut, especially if Light Peak is included. The one exception may be if Apple keeps one of the current generation 15-inch machines in the lineup as an entry model. If the 13-inch MBP also remains in the lineup, the new interfaces, CPUs and perhaps a higher resolution display will be what set it apart from the similarly sized Air.

Users are expected to be able to put this speedy new hardware to work with a new version of Final Cut Pro that should debut around the same time. MyYearbook Introduces Realtime Social Gaming With Video Chat

In general, the key driver of social networking so far is games on Facebook. But most of those games aren't social in the way that playing Monopoly or cards with your friends and family over the holidays is social. MyYearbook, which is a small but profitable social network focussing on younger teenage users, is going to try to make online games more social by getting its members to play together at the same time. The site has 4.7 million active visitors a month generating nearly 1 billion pageviews. It has about 1 million active users every day who spend a third of their time playing games and using other apps. The company makes its money from virtual currency and in-game offers, and is on track to make about $22 million in revenues this year, according to CEO Geoff Cook

In mid-December, myYearbook will launch a new set of a dozen live games which will combine casual games with live video chat. These are basic games like Warship, Gin Rummy, Chess, Checkers, line of Four, and Tic Tac Toe. MyYearbook is also partnering OMGPOP (which specializes in live online games), Heyzap, and Viximo to bring some of their games into myYearbook with a live video component. These aren't amazing games. That is not what they are about. They are designed to get people to interact with one another, to make new friends or to flirt. They are games everybody knows and everybody can play.

Trunk Notes: a Markdown-based wiki, to go

I know, I went and used "wiki" and "Markdown" in the headline and scared off all of the non-nerds. Nerds, welcome. If you're a non-nerd who kept reading, well, keep reading. Markdown is an easy way to create HTML, and wikis are a powerful means of connecting and organizing your notes. Your mobile note-taking deserves a peek at this.
Trunk Notes is a note-taking app with a built-in wiki (similar to VoodooPad). It works for both iPad and iPhone and provides great tools for editing (and rendering) Markdown. It also syncs with Dropbox and sends emails in Markdown or rich text (HTML). The wiki feature allows you to create automatic links between pages using WikiWord syntax. It's an extremely fast way to create linked notes with rich formatting.
If you don't know Markdown, take my word for it: it's easy. There is some great documentation included in the app, and you'll catch on quickly. WikiLeaked Diplomatic Cables Confirm China?s Politburo Was Behind Google Hacking Incident

Details about the U.S. State Department cables obtained by WikiLeaks are starting to come out. Although WikiLeaks itself may be under a denial of service attack, it provided several newspapers around the world access to the raw documents it is preparing to release later today. The New York Times just posted it's first article summarizing the contents of the cables and highlighting the most newsworthy ones.

Among the 251,287 U.S. diplomatic cables leaked by WikiLeaks, there is one set which deals with the massive computer attack on Google and other companies which was first revealed last January. At that time, Google went public with its contention that the attacks came from the Chinese government, and resulted in Google temporarily pulling out if China. They returned in a more limited way last summer.

Limera1n surprise

After a few very dramatic days in the jailbreak community, geohot has come out of nowhere to release limera1n. �It?s a bootrom-level jailbreak that works on the iPhone3GS, iPhone4, iPod touch 3G, iPod touch 4G, the iPad, and (technically) the AppleTV 2G.
DO NOT USE LIMERA1N IF YOU USE THE ULTRASN0W CARRIER UNLOCK ? wait for PwnageTool to incorporate the limera1n exploit.��This is so that you can avoid updating your baseband and losing the unlock (possibly forever).
Limera1n uses a different exploit than SHAtter, and in fact covers more devices. �Although some may question geohot?s dramatic and competitive style, he obviously does have considerable skill pulling this together in just over a day (although he?s had the underlying exploit for months). �Credit also goes to @comex, who provides the untethered aspect of limera1n via another one of his growing list of kernel hacks.
The release of limera1n has (thankfully!) averted the burning of 2 bootrom holes at once (both his and SHAtter). Releasing SHAtter now would be a complete waste of a perfectly good bootrom hole in light of limera1n, and so it can be held until Apple closes limera1n?s hole. �While there?s no guarantee that Apple won?t also close SHAtter by then, it provides a ray of hope for devices after Apple?s bootrom respin.
Update #1: Because the ?untethered? part of this jailbreak comes from a userland hack from @comex, you should still backup your SHSH hashes for 4.1. �Do this by either letting Cydia keep them (?make my life easier?), or using Tiny Umbrella. � This way you can always come back to an untethered, jailbreakable 4.1 on your devices after Apple has closed their 4.1 signing window (they?ll close the 4.1 window once they push out their next firmware version). If you fail to do this and ever need to restore to 4.1 again, you can still jailbreak but it will be a tethered JB (you?ll need to connect to your computer to finish the booting process, each and every time).
And remember: you can backup your 4.1 SHSH hashes without even being at 4.1 or even being jailbroken, by using Tiny Umbrella.

Apple hiring BlackBerry enterprise sales staff

The era of the BlackBerry's dominance in the corporate communicator market may be drawing to a close, and Apple is recruiting staff to speed that process along. Over the past year and a half, Apple has hired at least five senior enterprise sales reps from Research in Motion (RIM), the Canadian manufacturer of the BlackBerry.

In April 2009, Geoff Perfect joined Apple from RIM as Head of Enterprise iPhone Sales, and he has since been joined by four colleagues with contacts in the business. It's unknown how much of the increasing corporate adoption of iOS devices is due to the efforts of this crew and how much would have occurred organically as a result of employees bringing in their own iPhones. Either way, there has certainly been no love lost between Apple and RIM in recent months.

Apple has recently claimed that the iPhone is outselling the BlackBerry and that smaller seven-inch tablets are a bad idea. In response, RIM co-CEO Jim Balsillie has accused Apple of playing fast and loose with the numbers and spreading disinformation about devices like its upcoming PlayBook tablet. Ultimately, RIM's biggest problem is unlikely to be either staff poaching or executive sniping. Instead, it is the lack of any real innovation or even keeping pace with its products. Hiring Perfect and his colleagues is probably just a bonus for Apple.

Lost in translation: Microsoft retail stores not matching Apple success?

In a pattern we've seen repeated numerous times over the years, copying the superficial look and feel of something often does not yield the same end result. Over the years, Microsoft has frequently taken inspiration from the work of Apple, including Windows, Zune and, of course, its new retail stores. The record of commercial success for Redmond has been decidedly mixed, with Windows obviously being huge and the Zune a dismal failure.

Despite hiring (and then losing to Tesla) George Blankenship, who helped craft Apple's retail experience, and locating its stores adjacent to Apple stores, Microsoft just doesn't seem to be gaining much traction. So far, Microsoft has opened seven stores but hasn't said much publicly about their performance.

The LA Times did a bit of anecdotal analysis at the Shops at Mission Viejo mall, where the two stores sit near each other. Over the half hour period that the stores were observed, 19 customers walked out with purchases from Apple while only 3 did the same at the Microsoft store. This is far from a scientific analysis, but given the slow rate of expansion for Microsoft, it probably isn't atypical.

Microsoft has said little publicly about its goals for the stores, other than building its brand. The problem is that most of the products that the stores sell don't carry its brand, aside from a small Windows sticker or logo. Other than software and accessories, all of the main items available from an Apple store are from Apple.
The limited lineup of products made by Apple allows the stores to stock almost all of the variations available. Microsoft sells computers from HP, Samsung and others, and the limited space in a mall location means that it ends up with less selection and higher prices than a competing big box store like Best Buy. Without Apple's hard to define "cool" factor and more focus, it's not apparent whether Microsoft will be able to make a go of its stores, or if they will become the next Bob. What is it about Apple stores that makes you buy stuff there instead of Best Buy or Target?

iOS 4.2 makes iPad a productivity rival for MacBook Air, says CNET

CNET's Brook Crothers claims that with the launch of iOS 4.2, he is pretty much ready to abandon his MacBook Air in favor of full-time use of his iPad. Even before the upgrade to the mobile OS, Crothers found that he was almost exclusively using the 3G tablet in the airport, hotel and plane for his various tasks.

With the new functionality in 4.2 including multitasking, folders and printing he expects that trend to be amplified. The key to Crothers' argument is what he calls the iPad's "grab-and-go" capability. For content consumption and browsing as well as light editing/document creation, the iPad already wins easily; Crothers believes that future upgrades like twin cameras and perhaps even larger screens will only make the choice easier for him.

Unfortunately, Crothers does not mention whether he is comparing the iPad to an original MacBook Air or the new slimmer models that were recently introduced. For writers who don't need to integrate images or multimedia content into their web work (like Crothers) the iPad is a spot-on solution. For those with longer writing tasks, photo research or video editing, a proper laptop may be a more productive approach. Photofast AP1000 brings AirPlay audio streaming to your car

Now that iOS 4.2 and AirPlay are officially available for our Apple portable devices, we're starting to see third-party devices that can take advantage of the new capability. Among the first of those is the AP1000 from Japan's PhotoFast. The AP1000 is a Wi-Fi host that gets wired into a car audio system to receive AirPlay streams.

The little box supports 802.11b/g/n Wi-Fi signals, and once it's connected to 12 volt power and an input on the audio system, it should appear in the AirPlay connection screen on the iOS device. It's probably just as well that there doesn't appear to be any in-vehicle video streaming support with the AP1000, although it could be handy if you have a rear-seat entertainment system for the kids.

For many new vehicles that already have built-in support for Bluetooth audio streaming, the AP1000 doesn't really seem to provide any additional functionality, although the audio fidelity may be somewhat improved. PhotoFast is currently seeking a distributor outside of Japan, so we have no idea when the AP1000 will be available in the U.S. or how much it will cost. A lot of people out there still seem to think that all blogs do is riff off of major media content. Reblog it, or just plain plagiarism. Most people know that most major news is now broken by blogs, but the prejudice is still out there.

One thing we abhor is "the unattributed rewrite," When some publication takes a story that was broken by someone else and simply rewrites the same story in their own words without any attribution to the source of the story. It's just not done by reputable sites, whether they're blogs or mainstream media. A simple "the story was first broken by the Associated Press," or whoever, is the honorable thing to do.

Fixing what Apple won't

On Wednesday, Apple (finally) released firmware 4.0.2, which patches the very large security holes exploited by @comex in the 2nd incarnation of jailbreakme.com. �The only problem is they outright abandoned iPhone2G and iPod Touch 1G users! �Even though Apple acknowledges in their security update the severity of these holes, they left iPhone2G and ipt1G owners high and dry ? completely vulnerable to truly malicious variants of jailbreakme (these variants aren?t out yet, but they?re sure to come!).
Luckily for Apple, the Jailbreak community isn?t so callous. @saurik has been burning the midnight oil coding a Cydia package that will fix the holes for all devices and all firmware versions (even going back to version 2.x!). �It will be released very soon, after some more testing is done. �(Update: it?s available now?see update #2 below).

Limera1n surprise

After a few very dramatic days in the jailbreak community, geohot has come out of nowhere to release limera1n. �It?s a bootrom-level jailbreak that works on the iPhone3GS, iPhone4, iPod touch 3G, iPod touch 4G, the iPad, and (technically) the AppleTV 2G.
DO NOT USE LIMERA1N IF YOU USE THE ULTRASN0W CARRIER UNLOCK ? wait for PwnageTool to incorporate the limera1n exploit.��This is so that you can avoid updating your baseband and losing the unlock (possibly forever).
Limera1n uses a different exploit than SHAtter, and in fact covers more devices. �Although some may question geohot?s dramatic and competitive style, he obviously does have considerable skill pulling this together in just over a day (although he?s had the underlying exploit for months). �Credit also goes to @comex, who provides the untethered aspect of limera1n via another one of his growing list of kernel hacks.
The release of limera1n has (thankfully!) averted the burning of 2 bootrom holes at once (both his and SHAtter). Releasing SHAtter now would be a complete waste of a perfectly good bootrom hole in light of limera1n, and so it can be held until Apple closes limera1n?s hole. �While there?s no guarantee that Apple won?t also close SHAtter by then, it provides a ray of hope for devices after Apple?s bootrom respin.
Update #1: Because the ?untethered? part of this jailbreak comes from a userland hack from @comex, you should still backup your SHSH hashes for 4.1. �Do this by either letting Cydia keep them (?make my life easier?), or using Tiny Umbrella. � This way you can always come back to an untethered, jailbreakable 4.1 on your devices after Apple has closed their 4.1 signing window (they?ll close the 4.1 window once they push out their next firmware version). If you fail to do this and ever need to restore to 4.1 again, you can still jailbreak but it will be a tethered JB (you?ll need to connect to your computer to finish the booting process, each and every time).
And remember: you can backup your 4.1 SHSH hashes without even being at 4.1 or even being jailbroken, by using Tiny Umbrella.

Getting out of jail is free!

Fantastic news today from the Electronic Frontier Foundation (EFF). �After a lot of hard work and mountains of paperwork, jailbreaking your iPhone is now explicitly a permitted fair use under the DMCA!

The first of EFF?s three successful requests clarifies the legality of cell phone ?jailbreaking? ? software modifications that liberate iPhones and other handsets to run applications from sources other than those approved by the phone maker. More than a million iPhone owners are said to have ?jailbroken? their handsets in order to change wireless providers or use applications obtained from sources other than Apple?s own iTunes ?App Store,? and many more have expressed a desire to do so. But the threat of DMCA liability had previously endangered these customers and alternate applications stores.
In its reasoning in favor of EFF?s jailbreaking exemption, the Copyright Office rejected Apple?s claim that copyright law prevents people from installing unapproved programs on iPhones: ?When one jailbreaks a smartphone in order to make the operating system on that phone interoperable with an independently created application that has not been approved by the maker of the smartphone or the maker of its operating system, the modifications that are made purely for the purpose of such interoperability are fair uses.?

The EFF also successfully renewed the existing DMCA exception for carrier unlocking. �More on the ruling by the Library of Congress is here and here (and many other places, since this is huge news!). The full ruling is here, and EFF?s history with this case is here (EFF?s servers are understandably getting hammered today!).
This doesn?t mean that Apple will stop their technical attempts to thwart jailbreaking, but it does mean that our iPhone jailbreaks and unlocks are now unambiguously legal under the DMCA.

iAd highlighted in new Apple video

Apple has updated its iAd advertising site with a show-reel showcasing some of the early advertisement adopters. Of course the best of the best have been selected, and all of the campaigns featured look great. We've only seen a few here at TUAW, like the Nissan Leaf ad at pictured at right, but those were memorable.

Releasing this video is a good move on Apple's part, especially as iAd begins to launch internationally. It's an opportunity to show off some choice examples and gives a little reward to the program's early adopters.

Apple has recently increased iAd's international reach, announcing plans for Europe and Japan. Sometime in the last week or so, we've heard from multiple sources, Accel Partners has sold very significant chunks of Facebook stock. So significant, in fact, that their ownership percentage has dropped to a point where they are no longer the largest venture shareholder in the company.

Falcon Gunner, Star Wars augmented reality game for iPhone

Falcon Gunner (US$4.99) is a Star Wars-themed, augmented reality game for iPhone that superimposes battle scenes over live video of your surroundings. You say people give you grief for staring at your iPhone too much as it is? Now you can annoy them with the power of The Force.

Like many young boys in the late 70's, I dreamed of piloting the Millennium Falcon through space. That's just the experience that Falcon Gunner hopes to emulate, swapping outer space for wherever you happen to be. Your mission is to destroy incoming TIE fighters and ultimately the Death Star. Once the game is up and running, you're seated inside the cockpit, with two controls on either side of the screen. The left positions your gun while the right fires.

The augmented reality feature works much better than I expected. Ships zoom through your backyard as you fire. Authentic Star Wars sounds add to the experience, with roaring ships and encouraging squawks from R2D2 (at least I think he was being encouraging).

The temptation to blast lasers at your dog (or kids) is strong, but that leads to the Dark Side...and a quick death, as the TIE fighters aren't fooling around. For five dollars it's a good bit of fun and definitely challenging. 25 iPads used to make one big interactive touch display

This is awesome -- a group of musical composers and artists connected up 25 iPads in an installation commissioned by the Environmental Ministry of Japan to create a huge display 25 touchscreens big. Not only do the iPads stream one big image, but they're also interactive -- you can speed the image up or down by swiping, or even change each iPad's individual view. Each iPad also starts out playing one tune, all of them together in harmony, but as visitors come along and change the views and the speed and tone of the music, you eventually get 25 different sounds being played with 25 different views, a metaphor for how each of us affects our own little part of the world as we move through life. The challenge, then, is to get the iPads back together, all in sync, and rebuild the world that we each claimed a little part of.

You can watch video of how the installation works after the break, and there's also a hands-on video with a little more technical background on the project. It's very cool -- a project like this would be much more expensive (and probably a lot harder to do) without Apple's own magical and revolutionary device. Analyst says Apple is working on thinner CDMA-GSM iPad

With speculation about suppliers for the 2nd generation iPad already flying about, we're also hearing that Apple is working on creating a "World iPad" that would contain both GSM and CDMA capabilities making it compatible with phone carriers around the world.
According to All Things Digital, analyst Brian Blair of Denver-based Wedge Partners performed channel checks on wireless supplier Qualcomm and believes that Apple's next iPad will feature one of Qualcomm's multi-mode CDMA-GSM chips. Blair went on to say that Apple would be "ratcheting down production of the existing 3G iPad over the next two months" prior to starting production of the World iPad. Blair's recent supplier checks point to Apple building a whopping 48 million iPads during the 2011 calendar year.
The combo iPad would mean that Verizon Wireless, which uses a network based on the CDMA standard, would be able to offer iPads without having to rely on selling a Wi-Fi only model plus a MiFi mobile hotspot.
Blair's discussions with suppliers also indicate that the next-generation iPad will be thinner than the existing model, made from one piece of metal in a process similar to that used for the unibody MacBook Pros. As expected, the new model will have "at least" a front-facing camera for use in FaceTime video chats.
